Electronics in the US: What Most Sellers Overlook¶
Starting an electronics brand costs more than most founders expect — and not because of manufacturing. It is the testing and certification. Every electronic product sold in the US requires FCC compliance as a matter of federal law. UL certification is commercially mandatory even where it is not legally required. And if you sell on Amazon, you need both plus a General Certificate of Conformity before your listing goes live.
This guide walks through launching an electronics product with the compliance planned and budgeted from the start.

Step 1: Know Your Product's FCC Classification¶
Before you finalize your circuit board design, determine which FCC path applies:
- Intentional radiator: Your product deliberately transmits RF energy — Wi-Fi, Bluetooth, NFC, Zigbee, cellular. This requires FCC Certification — testing at an FCC-accredited laboratory, submission to a Telecommunications Certification Body (TCB), and an FCC ID permanently affixed to the product. Budget: \(5,000-\)15,000. Timeline: 6-10 weeks.
- Unintentional radiator: Your product contains digital circuitry but does not deliberately transmit — an LED driver, a motor controller, a coffee maker with a display. Most unintentional radiators also require FCC Certification. A smaller subset qualifies for a Supplier's Declaration of Conformity (SDoC). Budget: \(3,000-\)8,000. Timeline: 4-8 weeks.
If you are designing a product with wireless functionality — even a single Bluetooth module — you are firmly in the Certification pathway. Do not budget for SDoC and then discover during testing that you need full Certification.

If Your Product Contains a Lithium Battery¶
Any product containing a lithium-ion or lithium-metal battery — from a rechargeable Bluetooth speaker to a single-use coin cell in a remote control — triggers an additional layer of regulatory requirements:
- UN 38.3 testing: Lithium cells and batteries must pass UN Manual of Tests and Criteria Part III, subsection 38.3, covering altitude simulation, thermal cycling, vibration, shock, external short circuit, impact, overcharge, and forced discharge. This testing is mandatory for shipping via air, sea, or ground.
- Test summary: Since January 2020, manufacturers and distributors of lithium cells and batteries must make a test summary available that documents how the cell or battery passed UN 38.3. Amazon and major retailers increasingly request these.
- Shipping classification: Products containing lithium batteries are classified as Dangerous Goods (Class 9) for transportation. This affects your packaging, labeling, shipping documentation, and carrier eligibility. Budget \(1,000-\)3,000 for UN 38.3 testing and factor it into your product timeline — testing and documentation can add 3-5 weeks.
If you are importing a finished product that includes a lithium battery, your supplier must provide the UN 38.3 test summary and the battery's MSDS. Without these documents, your shipment can be rejected by the freight forwarder or held at the port.
Step 2: FCC Testing — Prepare for Emissions Failures¶
FCC testing measures the electromagnetic emissions your product produces. Products routinely fail on the first submission for emissions that exceed Part 15 limits. Common failure points:
- Switching power supplies without adequate filtering
- High-speed digital traces on the PCB acting as unintentional antennas
- Cable radiation from poorly shielded or unshielded cables
- Enclosure gaps that allow internal emissions to escape
Budget for at least one round of re-testing after the initial failure. A pre-compliance scan — an informal emissions measurement performed before the formal test — costs \(1,000-\)3,000 and can identify problems while they are still fixable at the PCB design stage. It is cheaper than a formal test failure and re-submission.
Step 3: UL Certification — Not Legally Required, but Practically Mandatory¶
There is no federal law that requires UL certification for consumer electronics. But:
- Amazon requires it for most electronics categories and will suppress listings without it
- Major retailers (Walmart, Target, Best Buy) require NRTL certification as a supplier condition
- Product liability insurers typically require NRTL certification before underwriting coverage
- Local electrical codes in many jurisdictions require NRTL-listed products for permanently installed equipment
In practice, if you are selling electronics at commercial scale, you are obtaining UL (or ETL, CSA, or TÜV — all are NRTL-recognized) certification. Budget \(5,000-\)25,000 depending on product complexity and whether your product involves mains voltage, batteries, or lithium-ion cells.
Step 4: Plan Your Label¶
Your product label must include:
- FCC ID — Permanently affixed to the product (not just the packaging). Format: "FCC ID: XXX123456789"
- NRTL mark — The UL, ETL, or CSA mark indicating safety certification
- Manufacturer or importer identification — Name and address of the US responsible party
- Prop 65 warning — If applicable (see Step 5)
If your product is too small for a physical label, the FCC ID may be placed in the user manual and on the packaging — but this exception must be explicitly justified, and the product must reference where the user can find the ID.
Step 5: California — Prop 65 and E-Waste¶
Two California-specific obligations affect nearly every electronics product:
Proposition 65: The most common electronics triggers are lead in solder and phthalates in PVC-insulated cables. If your product contains lead solder above the Prop 65 safe harbor level — and virtually all consumer electronics using standard tin-lead solder do — you need a warning on the product, the packaging, or at the point of sale. Lead-free solder avoids the warning but introduces manufacturing complexity and cost.
California e-waste (SB 20/50): If your product contains a display screen larger than 4 inches, it is subject to California's Electronic Waste Recycling Act. You must register with CalRecycle and pay a recycling fee collected at the point of sale. Other states — New York, Texas, Washington, Minnesota, and about 20 more — have their own e-waste laws with separate registration and reporting requirements.
Step 6: The EU Market — Plan It Now or Pay Later¶
If you plan to sell in Europe eventually, design for both markets from the start. Retrofitting a product designed only for FCC compliance to also meet CE Mark requirements is expensive. The key design decisions that affect both markets:
- EMC: FCC and CE EMC limits are different. A product that passes FCC may fail CE conducted emissions limits. Design with both standards in mind.
- RoHS: The EU's Restriction of Hazardous Substances directive restricts lead, mercury, cadmium, hexavalent chromium, and certain phthalates in electronics. There is no US federal RoHS equivalent. Designing to EU RoHS from the start — lead-free solder, phthalate-free cables — adds cost but avoids a redesign if you enter the European market.
- WEEE: The EU's e-waste directive requires producer registration, collection, and recycling in every EU Member State where you sell. Budget for ongoing compliance costs, not just initial registration.

Step 7: What Actually Happens When CBP Holds Your Shipment¶
CBP holds happen for administrative reasons — not because a product is dangerous. A missing FCC ID on the label, an incorrect HTS code, an incomplete importer of record filing, or a lithium battery without a UN 38.3 test summary can all trigger a hold.
When a shipment is held:
- Exam fees apply immediately. CBP may conduct a physical examination — opening cartons to verify the FCC ID, checking the product against the commercial invoice, or sending samples to a CPSC or FCC lab for testing. The importer pays the examination fees and the storage charges at the CBP-bonded warehouse, which run \(50-\)200 per day.
- The clock runs against you. You have a limited window to provide the missing documentation before CBP moves to formally exclude the goods. Once excluded, your options narrow to re-export (shipping the goods out of the US at your expense), destruction, or a formal protest — which takes months and rarely succeeds for missing compliance documentation.
- It affects future shipments. A CBP hold creates a record tied to your importer of record number. Future shipments from the same importer face a higher probability of secondary examination. A pattern of non-compliance can result in CBP requiring a continuous bond or placing your products on an automatic hold list.
The cost difference between having your compliance documentation ready before the shipment arrives versus scrambling after a CBP hold is typically \(2,000-\)5,000 in direct fees plus the value of delayed or lost sales. For a first-time importer, the difference between a well-documented shipment and a poorly documented one is often the difference between a successful launch and a financial loss on the first production run.
