Amazon Rules: US vs. EU vs. UK Requirements

Selling on Amazon's US marketplace requires CPCs, FCC IDs, and Prop 65 warnings. Selling on Amazon's EU marketplaces (Germany, France, Italy, Spain, Netherlands, and others) requires CE Declarations of Conformity, REACH SVHC communication, and WEEE registration. The Enforcement Difference: Automated vs. Reactive

Amazon's compliance enforcement architecture is the same across all three marketplaces — automated document requests, ASIN suppression, and a limited window to respond — but the specific triggers differ:

  • Amazon US: Strongest enforcement in toys and children's products. CPC and test report requirements are systematically enforced. FCC ID enforcement in electronics has increased significantly since 2023.
  • Amazon EU: Strongest enforcement in CE marking categories. The EU marketplace requires CE Declarations of Conformity to be uploaded for a wider range of product categories than the US requires CPCs. WEEE registration is enforced at the Member State level, with Germany being the most active.
  • Amazon UK: The UK marketplace is transitioning from CE to UKCA enforcement. During the transition period (through December 2027), CE marking is accepted — but Amazon UK has begun requesting both CE and UKCA documentation for new listings in anticipation of the 2028 mandatory switch.

The operational insight: listings in all three marketplaces should have their compliance documentation uploaded before going live, with separate documentation for each marketplace even if the underlying product is identical. Amazon's system does not recognize a US CPC as valid for an EU listing, even though both documents certify the same product's safety.

The Multi-Marketplace Seller's Documentation Strategy

1. Create a Master Compliance File per Product

For each SKU, maintain a master compliance file containing: - All test reports (US, EU, and UK standards) - All certificates (CPC, CE DoC, UKCA DoC) - All registrations (FCC ID, WEEE, state e-waste, facility registrations) - All chemical compliance documents (Prop 65 assessments, REACH SVHC screens, RoHS certificates) - Packaging compliance certificates (CA TPPA, EU PPWR)

This master file should be organized by marketplace and by document type — so when Amazon US requests a CPC, and Amazon Germany requests a CE DoC for the same product, both are instantly accessible.

2. Handle the Responsible Party Requirement

Amazon requires a local responsible party for each marketplace:

  • US: The manufacturer's or importer's US address must appear on the CPC and GCC. Amazon verifies this against the seller account.
  • EU: An EU-based Authorized Representative must be designated for CE marking purposes. Some EU Member States (Germany, France) additionally require a local representative under their national implementation of EU product safety rules.
  • UK: A UK-based Responsible Person must be designated for UKCA marking purposes.

These are three separate entities (or roles). A US address on a CPC does not satisfy the EU Authorized Representative requirement. An EU address does not satisfy the UK Responsible Person requirement.

3. Manage the WEEE / E-Waste Patchwork

  • US: 25 states have e-waste laws with separate registration, reporting, and fee requirements. No federal WEEE equivalent.
  • EU: Every EU Member State where you sell electronics must have a WEEE registration. Germany (EAR/Stiftung EAR), France (ADEME), and Italy (CdC RAEE) are the most active enforcers.
  • UK: The UK operates its own WEEE system through the Environment Agency. Registration with a Producer Compliance Scheme (PCS) is required.

Amazon enforces WEEE registration at the Member State level in the EU. A German WEEE registration number must be uploaded for electronics sold on Amazon.de. A separate Italian registration is required for Amazon.it. The registration obligations multiply by marketplace.

Frequently Asked Questions

Can I use the same test report for Amazon US and Amazon EU?

No. Amazon US requires test reports against US standards (ASTM F963, FCC). Amazon EU requires test reports against EU standards (EN 71, CISPR 32). The same lab can produce both reports from the same testing session, but the reports are separate and marketplace-specific.

Does Amazon share compliance documentation across marketplaces?

No. Amazon's compliance systems operate independently by marketplace. A CPC uploaded to Amazon US is not visible to Amazon Germany's compliance review. You must upload the correct documentation to each marketplace separately.

What happens if I list on Amazon EU without a CE DoC?

The listing may go live initially, but Amazon's automated compliance sweeps will flag it and request the CE DoC — typically within weeks of the first sale. If the DoC is not uploaded within the deadline, the ASIN is suppressed. A listing that is suppressed for compliance reasons cannot be reinstated until the correct documentation is uploaded and approved.
