GPSR Compliance Checklist: EU Product Safety Rules¶

1. Designate an EU Economic Operator (The "Responsible Person")¶
If you are an international manufacturer located outside of the European Union, you cannot legally sell consumer goods in the EU without a physical representative established in the Union.
You must formally appoint and contract an EU Economic Operator (commonly referred to as an EU Responsible Person or Authorized Representative).
Who Can Act as the Responsible Person?¶
- An EU-based manufacturer.
- An EU-based importer.
- A designated EU-based Authorized Representative.
- An EU-based fulfillment service provider (if no other entity is established in the Union).
What They Must Do:¶
The Responsible Person acts as the legal contact point for European market surveillance authorities. They must hold your product's technical safety files, verify that the product has valid Declarations of Conformity, and cooperate with authorities in the event of a mandatory safety recall.
2. Product Traceability: Label and Packaging Requirements¶
The GPSR mandates total physical and digital traceability. Every consumer product must clearly display the following information on the physical product itself, or where not possible due to size, on the packaging or an accompanying document:
- Manufacturer Details: The legal name, registered trade name, and physical/email address of the manufacturer.
- EU Responsible Person Details: The legal name, physical address, and email/website of your appointed EU Responsible Person.
- Product Identifiers: A clear model number, batch number, serial number, or GTIN (EAN/UPC) allowing the product to be tracked.
The Language Translation Mandate
All safety warnings, hazard labels, and user manuals must be translated into the official local languages of the specific EU Member States where the product is sold. If you sell a product in France and Germany, your safety instructions must be in both French and German. Offering a generic English-only manual is a major GPSR violation.
3. Product Safety Risk Assessments¶
Under the GPSR, you must proactively prove your product is safe. You must compile and maintain a technical file containing: * A comprehensive Product Safety Risk Assessment identifying potential hazards (e.g., choking risks, electrical hazards, chemical exposure) and how you have mitigated them. * Laboratory test reports proving compliance with applicable European safety standards. * Detailed technical drawings and product descriptions.
4. Online Listing Disclosures¶
The GPSR also regulates your online storefront. For every active product listing on Amazon or your D2C website, you must clearly display: * The name, address, and email of your EU Responsible Person. * The name, address, and email of the manufacturer. * High-resolution product images to aid in customer identification. * All mandatory safety warnings and hazard labels in the local language of the consumer.
5. Establishing a Safety Recall Protocol¶
The GPSR requires manufacturers and importers to have a documented, operational procedure for handling customer complaints, accident reporting, and mandatory safety recalls. If an accident occurs, you are legally required to report it to the EU's Safety Gate portal immediately.

Frequently Asked Questions¶
Does the GPSR apply to B2B products? No. The GPSR applies specifically to non-food consumer products placed on the EU market—meaning products intended for consumers or likely to be used by consumers under reasonably foreseeable conditions, even if not directly sold to them.
What happens if I sell through Amazon and do not have an EU Responsible Person? Amazon is legally liable for hosting unsafe goods. If you do not upload a verified EU Responsible Person's contact details and print them on your packaging, Amazon will permanently delist your products, withhold your funds, and destroy your inventory in EU fulfillment centers.
